When you make a booking with The Beach House People, these Terms and Conditions are deemed to be accepted by ALL GUESTS. Your booking is with The Beach House People, acting on behalf of the Property Owner. The Beach House People or the Property Owner will not be held responsible for any misinterpretations made. You are granted permission to occupy the property for holiday or short term accommodation purposes only. This is not a residential tenancy agreement under the Residential Tenancy act.

GUEST REGISTRATION 

Guest Registration is required for all bookings and we will request copies of a photo ID eg Drivers License for all adults over 18 years. As a security deposit, a pre-authorization of a credit card is required to cover any additional costs incurred including but not limited to breakage, damage or excess cleaning requirements. The pre-authorization is held for up to 7 business days after satisfactory inspection of the property. 

Extra Charges that may apply;

  • Removal of rubbish or pet waste – $150 minimum
  • Loss of keys – $80 plus the cost of replacement keys. Call out charges for out office hours and public holiday are $150. 
  • Damage/breakages –  AT COST
  • Movement of furniture & return to its original position  – $100 minimum
  • Unauthorised pets at the property – $500 minimum
  • Bins not put out for council collection in December & January – $80

The Beach House People operate a strict No Party Policy and if there is evidence of an unauthorised function the security bond will be retained and additional fees will be charged.

PAYMENT

Payment can be made via credit card (a surcharge will apply) or direct deposit.

DEPOSIT 

A deposit of 50% of the booking tariff is required to secure a booking. If the arrival date is within 30 days, full payment is required at time of booking. As a duty of care to our properties and Owners, The Beach House People reserve the right to refuse any bookings that are determined to be inappropriate or that fall across schoolies dates. Our properties are NOT “party houses” and as such we do not accept bookings for buck’s nights, hen’s nights or groups under the age of 25 years old. The booking fee is not refundable.

BALANCE

The balance of the booking tariff is to be paid in full at the latest 30 days prior to entering the property. Failure to pay the balance on time may result in cancellation of the booking and re-letting the property with no refund. 

CANCELLATION FEE

You can cancel a booking anytime up to 30 days before arrival. For refund processing we charge an $90 administrative fee and we cannot refund any third party credit card fees. 

The Beach House People will not be held responsible if the accommodation does not meet your expectations. Relocation is not an option. If your booking is cancelled by The Beach House People the amount paid less the booking fee will be refunded to you upon receiving your bank details. If the booking payment was made by Credit Card, the credit card surcharge cannot be refunded.

The Property Owner may cancel reservations at any time including reservations with deposits in place. If the booking is cancelled by The Beach House People or Property Owner a full refund will be provided minus any credit card surcharges incurred. The Beach House People accept no responsibility for actions by the Property Owner i.e.- property/contents altered, property sold, withdrawn from letting, increase of booking tariff or alterations made. 

CHECK IN

Check in is strictly after 2.00pm on the day of arrival. For December and January the check in time is 3pm. We operate a contactless ‘self-check-in’ using a secure key safe situated at the property. On the day of arrival, you will be emailed the key safe instructions and the access code at 2.00pm. Access to the property before 2pm is strictly prohibited. No guests will be given the key safe code until the check in online/registration process has been fully completed, the booking tariff for the stay has been paid in full and the security deposit pre-authorization has been received. If upon arrival to the property there are any issues related to cleanliness or damage you must report such items to The Beach House People promptly and to allow contractors or employees inspect the property and to rectify. If you arrive after 5pm any issues will not be attended to until the next business day. The Beach House People are not responsible for alternate accommodation or any other costs when guests arrive after hours if no prior arrangement has been made.

CHECK OUT

Check out is strictly at 10.00 am. If you or any guest fails to vacate the property by 10.00 am, a fee ranging from $110.00 to the equivalent of one night’s accommodation will apply, depending on how late you vacate the property. We ask that when you leave the property you ensure the property is locked and the keys are put back into the key safe. The property should be left in a neat and tidy state, including turning off all lights, air conditioning, TVs before your departure. Fees will apply if the property requires extra cleaning after your departure.

CONDITIONS OF STAY

NUMBER OF GUESTS & PARKING

The number of guests should not exceed to the number indicated on your booking confirmation. This is a strict regulation set by the Bass Coast Shire Council, If at any time we find you are accommodating more people than you have advised, we reserve the right to evict all guests from the property. Should this occur, no refund will be provided. 

Guests are not to exceed the number of car parks advertised and should seek alternative permitted public parking so not to inconvenience neighbouring properties. No caravans or tents are permitted on the premises at any time. 

NOISE and PARTIES

Parties and functions are strictly prohibited. Our properties are not “party houses” and we take a ZERO TOLERENCE approach to any offensive noise and anti-social behavior. Any noise should be kept to a minimum from 10pm to 8am. Any offensive noise, complaints from neighboring properties, disruptive or illegal behaviour will be grounds for immediate eviction from the property with no refund payable and a full security bond may also be forfeited.

The Beach House People reserve the right to inspect the property at any time of day or night if we are made aware of inappropriate behaviour or breach of these conditions. Any parties or anti-social behavior will be reported to the police. 

KEYS

One set of keys will be provided for the duration of your stay. It is your responsibility and ALL Guests to coordinate the possession of keys between yourselves. If the keys are lost or need to be replaced a call out fee of $80 plus the cost of the replacement keys will apply and will be taken from the security deposit. After hours’ delivery’ of lost or misplaced keys is not guaranteed. Call outs required after hours or on public holidays the fee $120. 

GENERAL CLEANLINESS, DAMAGED APPLIANCES

We request that all guests and visitors respect our properties by leaving the house and grounds clean and tidy. It is the guest’s responsibility to maintain the cleanliness of the property during your stay. Upon vacating the property is to be left clean/tidy, BBQ cleaned, the fridge to be empty and dishwasher on, wet towels to be put in a laundry bag. Bins must be emptied and outside bins are to be put for council collection upon check-out. Cleaning or damage charges may apply if property left in unacceptable condition.

You must not move items or furniture (indoor or outdoor) within the property. Movements may cause unnecessary damage, H&S concerns for Cleaners and cause excess cleaning time. Any damages/excess cleaning caused by movement of items or furniture will be deducted from the security bond.

If trades people or service technicians need to be called out for an appliance malfunction or breakdown and it is determined that operator error is the reason for the malfunction, guests will be required to pay the bill for the service call & repairs. 

TV, INTERNET AND PAID TV/FOXTEL

We do not guarantee TV , internet or paid TV services such as Foxtel for reception or performance.

PETS

Pets are only permitted at pet-friendly properties. You must ensure your pets are up to date with worming, flea treatments and vaccinations.

  • Please bring your own bedding and bowls for your pets
  • Do not allow pets on any furniture, bedding or rugs – any damage will be charged for. 
  • Do not lock pets inside while you are out. We do not take responsibility for pets left in courtyards or fenced gardens, you must do so at your own risk.
  • Please check the courtyards and garden areas thoroughly before you leave and clean up any mess left by your pets. Failure to do so will incur $150 instant fee. 
  • Please report any damage. 
  • Additional cleaning charges may apply if pet hair, urine/waste, fleas or any evidence (including smell) of the pet be left behind when you leave. 

The Beach House People accepts no responsibility for death of, loss of, injury or sickness to pets during your stay and upon acceptance of these terms and conditions you and ALL GUESTS agree that no legal action (including payment of veterinary accounts) will be taken against The Beach House People or the Property Owner and that no discussion will be entered into. Our properties are NOT Pet Friendly, unless stated otherwise.

NO SMOKING

The Beach House People operates a strict NO SMOKING policy in all our properties. All properties are smoke free zones (i.e. both inside the home and outdoors). Any evidence of smoking or cigarette ends left at the property, including grounds and garden, plant pots, will incur an additional cleaning fee of $150 and will be deducted from the Security Bond.

POOLS AND SPA’S/GENERAL SAFETY OF CHILDREN

Please do not alter any pool or spa equipment during your stay. You should contact us immediately if you have issues or problems with the pool or spa or its equipment. No glassware is to be taken into the pool area. Pools and spas may only be used between the hours of 7.00am and 10.00pm.  Children and pets must be supervised at ALL times near the pool or spa. 

Please note many of the houses are family friendly but this does not mean they are safe for young children. It is the full responsibility of you the guest to ensure your children are supervised on balconies, stairs, gardens at all times and you are aware there may be dangerous cleaning liquids in kitchens and bathrooms.

RUBBISH AND BINS

Please ensure that you that you put all 3 bins out on the roadside on Tuesday evenings for Inverloch, Monday for Cape Paterson & Kilcunda. If there is any rubbish left anywhere in the property or grounds, it must be removed and failure to do so will incur a charge. 

BBQ’S AND GAS BOTTLES

BBQ’s must be supervised at all times and cannot be used on total fire ban days. Please ensure that you clean the BBQ and utensils at the end of your stay and turn the gas off. Failure to clean the BBQ completely will result in a $80 fee. If the gas bottle on the BBQ runs out of gas, please take the gas bottle to the local service station on the corner and keep the receipt so we can immediately reimburse you for the cost. 

GENERAL SECURITY

Your personal items are left in the house at your own risk and it is essential that you turn off  portable heaters and ovens whilst you are out of the property. 

BUILDING AND RENOVATION WORKS 

Our properties are located in suburban locations where building or renovation work may occur. Neither The Beach House People nor the property owner are responsible for any noise from neighbouring properties caused by building or renovation work.

INDEMNITY

You indemnify The Beach House People and the Property Owner against all liability which might otherwise attach to the Property Owner as a result of injury, damage or loss (personal and proprietary) suffered by any person, where such injury, damage or loss has been caused by or contributed to by any act or omission of you, ALL guests or your visitors. You book, live-in, use the property and leave your personal belongings there at your sole risk. You release The Beach House People and the Property Owner from any claim arising from, but not limited to injury, loss, theft or from any occurrence beyond our control such as, but not limited to, natural disasters, acts of terrorism, acts of God, delays, cancellations or government regulations. 

NO CLAIMS AGAINST The Beach House People

The Beach House People is the property manager only and acts only for the Property Owner. You agree that, to the maximum extent possible at law, no claim may be brought against The Beach House People in relation to the property or your stay at the property. These conditions are an agreement between The Beach House People and all Guests. 

PRIVACY COLLECTION NOTICE

Your personal information collected by The Beach House People and is used to allow us to provide a professional service. We are required to obtain your consent to the collection and use of your personal information. The information collected may be disclosed to other parties including the landlord and tradespeople. If you would like to access your personal information held by us, you can do so by contacting The Beach House People in writing on the contact details listed on this form.
